Introduction
These Terms of Service govern your access to and use of the services provided by CryptoHub. By accessing our platform, engaging our Crypto advice, or using our educational content, you agree to be bound by these Terms. If you do not agree, please do not use our services.
CryptoHub Disclaimer
CryptoHub provides Cryptocurrency guidance and educational courses focused exclusively on Digital Assets. Our advice is based on current market conditions and reasonable professional judgment, but cryptocurrency markets are inherently volatile and speculative. CryptoHub does not guarantee the performance of any investments or strategies discussed, and we are not liable for any financial losses, missed opportunities, or damages arising from your use of our services, except where liability cannot be excluded under applicable law. Clients are solely responsible for their investment decisions and should conduct independent research or consult other qualified professionals before investing. Cryptocurrency investments carry significant risks, including the potential for total loss of funds.
Nature of Services
• Educational and Crypto Advice Services: CryptoHub provides cryptocurrency education and guidance, including one-on-one consultations, courses, webinars, and market analysis. Our services are delivered by Keir Mcilwham, who holds a New Zealand Certificate in Financial Services (Level 5).
• Non-Regulated Advice: Cryptocurrencies are not classified as financial products under New Zealand law. Our advice is therefore not regulated financial advice under the Financial Markets Conduct Act 2013, and CryptoHub is not a licensed Financial Advice Provider (FAP).
• No Guarantees: Our advice is for informational and educational purposes only. We do not guarantee financial outcomes, profits, or the accuracy of market predictions.
Services
CryptoHub is an online platform offering:
• Personalised Cryptocurrency advice on crypto investments.
• Educational courses, webinars, and resources on cryptocurrency trading, investing, and blockchain technology.
• Market analysis and insights on cryptocurrency trends.
Services are primarily delivered online. In-person consultations or workshops may be available in Queenstown, New Zealand, subject to availability.
Arbitration
Any disputes arising from these Terms or our services shall be resolved through binding arbitration in accordance with the Arbitration Act 1996 of New Zealand. Arbitration shall occur online or in a mutually agreed public location in Queenstown or Christchurch.
Payment Terms
Fees
• Crypto Advice consultations are charged per session at NZ$300 per hour.
• Premium courses are subject to fees, outlined at purchase.
• No-Show Fee: A $100 NZD fee will be charged if a client fails to attend a scheduled Crypto advice session without providing at least 24 hours’ notice or does not join within 15 minutes of the scheduled start time.
All fees are clearly outlined and agreed upon before any contract or service is undertaken.
Billing:
• Invoices for consultations and courses are due within 7 days. If unpaid after 30 days, we may engage a debt collection agency.
Consultation Charges:
Clients are charged only for time spent in advice sessions.
No Refunds: Payments for services, including courses, subscriptions, and sessions, are non-refundable, except where required by law.
Release of Liability
By using our services, you release CryptoHub, its employees and agents from any claims, liabilities, damages, or costs (including lost funds or investments) arising from your use of our financial advice or educational content, except in cases of proven gross negligence or wilful misconduct. CryptoHub is not responsible for financial losses due to market volatility, your investment decisions, or external factors beyond our control.
User-Generated Content
CryptoHub is not responsible for content submitted by users (e.g., comments, forum posts, or session discussions). Users are solely responsible for their content and its consequences.
Privacy Policy
Data Collection: We collect only necessary personal data to provide our services. Anonymised usage data may be collected to improve our platform.
Data Sharing: We do not share personal data with third parties, except to process payments, comply with legal obligations, or with your consent.
Confidentiality
CryptoHub will maintain the confidentiality of information shared during any sessions. Clients agree not to disclose CryptoHub’s proprietary materials, strategies, or content to third parties without written consent.
Indemnification
Clients agree to indemnify and hold CryptoHub, its employees harmless from claims, damages, or expenses arising from their use of our services, including losses from Cryptocurrency investments.
Force Majeure
CryptoHub is not liable for failure to perform obligations due to events beyond our control, including acts of God, war, cyberattacks, or natural disasters.
Client Acknowledgement
You acknowledge that:
• CryptoHub provides Cryptocurrrency advice and education, but investment decisions are your responsibility.
• Cryptocurrency investments are high-risk and may result in total loss of funds.
• CryptoHub is not liable for financial losses or adverse outcomes from your reliance on our advice, market conditions, or external factors, except where required by law.
Changes to These Terms
We may modify these Terms at any time. Changes are effective upon posting on our website www.cryptohub.co.nz. Significant changes will include a 5-day notice via email or our platform. Continued use constitutes acceptance.
